Terms of Service

The terms on which the Smart Preservation Platform is made available.

In effect from 21 October 2026.

The agreement

These terms are an agreement between Nursultan Kadirov, who operates Smart Preservation Platform (SPP), and the person or organisation that subscribes to it. Creating an account, or using the platform, accepts them. Where a separate written agreement has been signed with a customer, that agreement governs and these terms fill any gap in it.

What is provided

SPP is a hosted service for planning, scheduling, executing and recording the preservation of industrial equipment: a tag register, job plans and steps, automatically scheduled activities, issued and closed job cards, and the reports and handover documents that follow from them. It is provided as it stands at the time of use. Features are added and improved over time, and a change that removes something a customer relies on is notified before it takes effect.

Licensed, not sold

A subscription grants a limited, non-exclusive, non-transferable right to use SPP for the customer's own internal business purposes, for as long as the subscription is paid and in force. It transfers no ownership of the software and no entitlement to a copy of it. What is reserved is set out in the Legal Notice.

Accounts and access

An account belongs to one person. Credentials are not to be shared, and a login signed in from a second place ends the first — that is deliberate, and it is how SPP keeps one login to one person. A customer administrator is responsible for who they invite into their workspace and for removing access from people who have left. Tell us promptly if you believe an account has been compromised.

A session closes after ten minutes without activity. That is a security measure, not a fault.

The customer’s own data

Everything a customer enters — tags, job plans, schedules, job cards, comments, attachments — remains that customer's property. SPP claims no rights in it, does not use it to train anything, and does not disclose it to another customer. It is processed only to provide the service, on the terms of the Privacy Policy.

Documents are written to the document store the customer nominates, inside the customer's own account with that provider. The customer's relationship with that provider, and the availability of that store, are the customer's own; SPP is not responsible for a failure inside it. A connection can be withdrawn at any time.

A customer may export their records at any time while the subscription is in force.

Acceptable use

  • Do not copy, decompile, reverse engineer or attempt to derive the source code of SPP, or resell, sublicense or make it available to anyone outside your organisation.
  • Do not attempt to reach another customer's workspace, probe or attack the platform, or circumvent any limit or security measure in it.
  • Do not upload material that is unlawful, that infringes somebody else's rights, or that you have no right to place in the nominated document store.
  • Do not use SPP in a way that breaks the law applicable to you, including export control and sanctions law.

Access may be suspended where use breaches this section and the breach is not corrected after notice — or immediately, without notice, where the breach threatens the platform or another customer.

Fees and payment

The subscription is charged for a period of use at the price quoted when the order was placed, in advance, and it renews automatically for a further period unless it is cancelled before the term ends. Payment is taken by the payment provider named on the checkout page, or by bank transfer against an invoice. Prices are quoted exclusive of any tax that the customer's own jurisdiction imposes on them.

Payments are not refunded. A workspace is created and opened in full the moment payment is taken, so there is nothing held back to return. Cancelling is free and takes effect at the end of the term already paid for. The Refund Policy sets this out, including the one case that is not a refund at all: money taken in error is returned.

A price change takes effect only at the start of a renewal period, and is notified at least thirty days before it does. Where a payment fails, access is kept open while the problem is resolved; where it stays unresolved, the subscription is suspended and then ends.

Cancellation and what follows

A subscription can be cancelled at any time and runs to the end of the period already paid for. When the term ends the workspace locks: the application stops being usable, and that is the whole of what happens to it.

Nothing of yours is deleted. Every record stays as it was, and paying to renew brings the same screens back with the same data — no re-entry, no restore, no lost work. An unpaid invoice is a reason to stop serving somebody; it is not a reason to destroy what they did.

A locked workspace cannot be opened or used, so an export is not something you can take yourself once the term has ended. Ask us and we will send it — the renewal notice goes out a fortnight before the date and says so, and the request is honoured afterwards too.

Records are removed only when you ask, or after a prolonged period with no renewal, and in that case we write to the address on the account before anything is removed. A renewal notice is sent by email before each term ends, so the date is never a surprise.

Availability

SPP is run to be available continuously, but it is not warranted to be uninterrupted or error-free. Planned maintenance is announced in advance and kept outside working hours where that is possible. Where a formal availability commitment is required, it is agreed in writing with the customer and is not implied by these terms.

Preservation remains the customer’s responsibility

SPP schedules, records and reports preservation work. It does not perform it, inspect it or certify it. The decision that a piece of equipment is fit, that an activity was done correctly, and that a job card may be signed, stays with the customer's own competent people, and nothing produced by SPP substitutes for their judgement or for the requirements of a contract, a standard or a regulator.

Liability

To the extent the law allows, neither party is liable to the other for indirect or consequential loss, or for lost profit, lost production, lost revenue or lost data, however it arises. The operator's total liability arising out of or in connection with the service is limited to the fees paid by that customer for the twelve months before the event giving rise to the claim.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that the law does not permit to be limited.

Confidentiality

Each party keeps the other's non-public information confidential and uses it only for the purposes of this agreement. That obligation survives the agreement.

Changes to these terms

These terms may be amended. The date at the top changes when they are, and an amendment that materially affects customers is notified by email at least thirty days before it takes effect. Continuing to use SPP after that date accepts the amended terms; a customer who does not accept them may cancel, and their workspace runs to the end of the term already paid for.

Governing law

These terms are governed by the law of the Republic of Kazakhstan, and the courts of the Republic of Kazakhstan have jurisdiction over any dispute arising from them. Before going to court, both parties will try in good faith to resolve the matter in correspondence.
